Claiming a New York City Real Property Transfer Tax Exemption for Transfers to or from Housing Development Fund Companies (HDFC) – Using ACRIS to create NYC-RPT
Beginning August 19, 2016, taxpayers may be eligible to claim a full or partial Real Property Transfer Tax exemption for transfers of real property, or economic interests therein, to or from Housing Development Fund Companies, or entities in which a Housing Development Fund Company owns a controlling interest (collectively known as an “HDFC Transfer”) under Section 11-2106(b)(9) of the Administrative Code of the City of New York (the “HDFC Exemption”).

Effective March 24, 2017, the NYC-RPT form has been revised to include:

  1. A new Condition of Transfer w. Transfer to an HDFC or an entity controlled by an HDFC
  2. A new Schedule L – HDFC Exemption

City Register Now Accepts All Documents Electronically
All real property transfer tax returns, including returns for transfers of real property located in Staten Island, must be filed electronically using ACRIS. Real property transfer tax returns for transfers of real property located in Staten Island must also be filed in paper form.

    3. If a transaction involves single and multiple documents, can some be submitted via eRecording and others via the regular submission process?

    No, all documents from one transaction must be submitted in the same manner, either via eRecording or via the regular submission process.

    Completing a Cover Page for a UCC Financing Statement
    The Document Date entered should be the same as the Cover Page preparation date, or within six months of the initial UCC filing's expiration date.

    Flip Transactions
    When a Flip Transaction (a transfer from party A to B, then party B to C) is involved:

    ACRIS converts all uploaded PDF files to images for final archival purposes. It is your responsibility to ensure that the uploaded PDF can be properly converted. If it cannot, clarity may be lost during the conversion process, and as a result, your submission may be rejected, or the document may be placed in the public record with reduced clarity.

    To ensure that the PDF can be properly converted to images, please be sure that your PDF meets the following guidelines:
